Terms of Service

1. Introduction

Welcome to The Posy Post. These
Terms of Service (“Terms”) govern your use of our website, products and
services. By placing an order with The Posy Post, you agree to be bound by
these Terms. Please read them carefully before placing your order.

While we will do everything
possible to ensure your order ends up in the loving care of the intended
recipient, on the rare occasion, some things can go wrong. We are always
reasonable and will take each order on a case-by-case basis.

2. Placing Orders

2.1 All orders are placed
through our website and are subject to availability. By placing an order, you
confirm that all information provided (including delivery address, recipient
details, and contact information) is accurate and complete.

2.2 Once an order is placed and
payment is received, you will receive an order confirmation via email. This
confirmation does not guarantee delivery at a specific time (see Section 3
below).

2.3 The Posy Post reserves the
right to refuse or cancel any order at our discretion, including where we
suspect fraudulent activity or where an order cannot be fulfilled.

3. Delivery

3.1 Delivery Areas and Times

Deliveries are made within our
designated delivery areas on available delivery days. Delivery areas and
schedules are displayed on our website and may change from time to time.

3.2 Delivery Time Requests

While we’ll always do our best
to meet delivery time requests, we cannot guarantee specific delivery times.
Once all orders for the day are received, our delivery route is structured to
ensure the most efficient route for our drivers. You’re welcome to request a
delivery time and we’ll do our best to accommodate this, however, we can never
guarantee any specific time requests.

3.3 Incorrect Addresses

It is the sender’s
responsibility to ensure that the correct delivery details have been provided.
If an incorrect address has been provided and the order has been delivered to
that address, the sender will forfeit the order. In this circumstance, we will
offer a 50% discount code for a replacement order to be delivered on the next
available delivery day.

3.4 Secure Apartments and Properties

If the order is being sent to a
secure apartment or property, please ensure the recipient is home to receive
the order. If the recipient is not home at the time of delivery or there is
nowhere safe to leave the order, the sender or recipient will be contacted and
we will attempt to re-deliver the same day to an alternative address, if
possible. If re-delivery is not possible, the order will be available for
pick-up from our studio in Warners Bay the following day between 8:30am and 3pm
(Monday to Friday).

3.5 Recipient Not Home

If no one is home or there is
no answer at the time of delivery, we will leave the order in some water by the
front door where it is safe to do so. If there is nowhere safe to leave the
order, the sender or recipient will be contacted and we will attempt to
re-deliver the same day to an alternative address, if possible. If re-delivery
is not possible, the order will be available for pick-up from our studio in
Warners Bay the following day between 8:30am and 3pm (Monday to Friday).

3.6 Recipient No Longer at the Given Address

If the recipient is no longer
at the given address (such as a workplace), we will leave the order with their
colleagues where possible.

If the recipient has been
discharged from hospital, the sender or recipient will be contacted. We will
always do our best to redirect the order to an alternate address, however, this
may not always be possible due to delivery time constraints. If redirection is
not possible, the order will be available for pick-up from our studio in
Warners Bay the following day between 8:30am and 3pm (Monday to Friday).

3.7 Internal Mail Rooms

If an order has been delivered
to an internal mail room or reception and the order has not been passed on to
the intended recipient, The Posy Post cannot be held responsible. Any queries
regarding the handling of the order after delivery to a mail room should be
directed to the relevant organisation.

3.8 Other Reasons for Non-Delivery

If there is any other reason
that we are unable to deliver an order to the intended recipient, the sender or
recipient will be contacted and we will attempt to re-deliver the same day to
an alternative address, if possible. If re-delivery is not possible, the order
will be available for pick-up from our studio in Warners Bay the following day
between 8:30am and 3pm (Monday to Friday).

4. Product Information

4.1 Our posies and floral
arrangements are made with the freshest seasonal flowers available. As we work
with natural, seasonal products, the exact flowers and colours may vary from
those shown on our website or social media. We take pride in ensuring every
arrangement is beautiful and of a high standard.

4.2 Images on our website and
social media are for illustrative purposes only. While we strive to represent
our products accurately, slight variations in colour, flower type, and
arrangement may occur due to seasonal availability.

4.3 Fresh flowers are a
perishable product. The Posy Post is not responsible for the care of flowers
after delivery. We recommend following any flower care instructions provided
with your order to maximise the longevity of your arrangement.

5. Pricing and Payment

5.1 All prices on our website
are listed in Australian Dollars (AUD) and include GST where applicable.

5.2 Payment must be made in
full at the time of placing your order. We accept payment via the methods
displayed on our website, which may include credit/debit cards, PayPal,
Afterpay, and other payment methods as available.

5.3 The Posy Post reserves the
right to change prices at any time without prior notice. However, any price
changes will not affect orders that have already been confirmed.

6. Faulty Products and Complaints

6.1 If you believe your order
is faulty or not of an acceptable standard, you must contact us via email at
hello@theposypost.com.au within 5 hours of receiving your order. Please include
photographs of the issue.

6.2 We will review each
complaint on a case-by-case basis. Where we determine that a product is faulty,
we will work with you to find an appropriate resolution, which may include a
replacement arrangement or store credit.

6.3 Nothing in these Terms is
intended to exclude, restrict, or modify any consumer guarantees, rights or
remedies you may have under the Australian Consumer Law (Schedule 2 of the
Competition and Consumer Act 2010 (Cth)) or any other applicable law that
cannot be excluded by agreement.

7. Refunds and Cancellations

7.1 As a general policy, The
Posy Post does not offer refunds except in the circumstances outlined below or
as required under the Australian Consumer Law.

7.2 Refunds for delivery area
or availability issues:

If a refund is required because
the delivery address falls outside our delivery area, or because the day’s posy
is sold out and the delivery cannot be moved to another day, a full refund will
be provided.

7.3 Cancellations and change
of mind:

If you wish to cancel your
order due to a change of mind, a minimum of 24 hours’ notice before the
selected delivery date is required.

7.4 Australian Consumer Law:

Under the Australian Consumer
Law, you are entitled to a remedy (including a refund, replacement, or repair)
if goods are faulty, not as described, or do not meet a consumer guarantee.
These rights cannot be excluded by these Terms. If you believe you are entitled
to a remedy under the Australian Consumer Law, please contact us at
hello@theposypost.com.au.

8. Gift Messages

8.1 Gift messages provided at
checkout will be included with the delivery as written by the sender. The Posy
Post is not responsible for the content of gift messages and will reproduce the
message as provided. Please check your message carefully before submitting your
order.

8.2 The Posy Post reserves the
right to refuse to include any gift message that we deem to be offensive,
threatening, or otherwise inappropriate.

9. Intellectual Property

All content on our website,
including images, text, logos, graphics, and designs, is the property of The
Posy Post or its licensors and is protected by Australian and international
intellectual property laws. You may not reproduce, distribute, or use any
content from our website without our prior written consent.

10. Limitation of Liability

10.1 To the maximum extent
permitted by law, The Posy Post’s total liability to you for any claim arising
out of or in connection with these Terms or our products and services is
limited to the value of the order in question.

10.2 To the maximum extent
permitted by law, The Posy Post is not liable for any indirect, incidental,
special, consequential, or punitive damages arising out of or in connection
with your order or use of our services.

10.3 Nothing in these Terms
excludes, restricts, or modifies any right or remedy, or any guarantee,
warranty or other term or condition implied or imposed by any applicable law
which cannot lawfully be excluded or limited, including the Australian Consumer
Law.

11. Privacy

Your personal information is
collected, used and disclosed in accordance with our Privacy Policy, which is
available on our website. By using our services, you consent to the collection,
use, and disclosure of your personal information as described in our Privacy
Policy.

12. Governing Law

These Terms are governed by the
laws of New South Wales, Australia. Any disputes arising from or in connection
with these Terms shall be subject to the exclusive jurisdiction of the courts
of New South Wales.

13. Changes to These Terms

The Posy Post reserves the
right to modify these Terms at any time. Updated Terms will be published on our
website with the revised “Last Updated” date. Your continued use of our
services after any changes constitutes acceptance of the updated Terms. We encourage
you to review these Terms periodically.
